Unlicenced Barrie driver charged with impaired in Innisfil after collision

A driver from Barrie was given multiple charges, including impaired driving after a single-vehicle collision in Innisfil Wednesday.

At 9:20 p.m., South Simcoe Police got a report of a single-vehicle collision on Shore Acres Drive. Upon arrival, officers located a silver Nissan Versa on the northbound side of the roadway with significant damage.

The vehicle had rolled over after swerving off the road, and the driver sustained minor injuries. He was later brought to hospital as a precaution.

However, police found empty alcoholic beverage containers in the vehicle, and eventually formed grounds to believe the 29-year-old male driver was impaired.

Criminal Code (R.S.C., 1985, c. C-46) 320.13(1)—Dangerous operation

Everyone commits an offence who operates a conveyance in a manner that, having regard to all of the circumstances, is dangerous to the public.

Criminal Code (R.S.C., 1985, c. C-46) 320.14(1)(a)—Operation while impaired

Everyone commits an offence who operates a conveyance while the person’s ability to operate it is impaired to any degree by alcohol or a drug or by a combination of alcohol and a drug

Criminal Code (R.S.C., 1985, c. C-46) 320.14(1)(b)—Operation while impaired

Everyone commits an offence who subject to subsection (5), has, within two hours after ceasing to operate a conveyance, a blood alcohol concentration that is equal to or exceeds 80 mg of alcohol in 100 mL of blood

Highway Traffic Act, R.S.O. 1990, c. H.8 32(1)—Driver’s licence

No person shall drive a motor vehicle on a highway unless the motor vehicle is within a class of motor vehicles in respect of which the person holds a driver’s licence issued to him or her under this Act.

Highway Traffic Act, R.S.O. 1990, c. H.8 44.1(3)—Condition on licence that blood alcohol concentration level be zero

Every novice driver who contravenes the condition of his or her driver’s licence imposed under subsection (1) is guilty of an offence and on conviction is liable to a fine of not less than $60 and not more than $500.

The man’s vehicle was impounded and he is scheduled to appear in court in September.
